These Terms & Conditions (“Terms”) govern your use of Americano (the “App”) and related services (collectively, the “Service”), operated by the publisher of Americano (“we,” “us,” “our”). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
The Service
The Service provides tools to discover and participate in tournaments, manage match play (including scores and rounds), view standings and rankings, and manage player profiles. Features may change over time. We may suspend or discontinue any part of the Service with or without notice.
Eligibility
You must be at least 13 years old and capable of entering a binding contract in your jurisdiction. You represent that the information you provide is accurate.
Accounts
You are responsible for safeguarding your credentials and for all activity under your account. Notify us at hello@umair.au if you suspect unauthorized access. We may refuse registration or suspend accounts that violate these Terms.
Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in violation of applicable law;
- harass, abuse, threaten, or harm others;
- manipulate scores, rankings, or tournament data dishonestly;
- attempt to gain unauthorized access to systems, accounts, or data;
- interfere with or overload the Service;
- reverse engineer, scrape, or misuse the Service except as permitted by law;
- impersonate another person or misrepresent your affiliation.
We may remove content or suspend or terminate accounts for violations.
Tournaments, content, and organizer activities
Tournaments may be organized by independent organizers or venues. You understand that organizers are responsible for their events (including rules, eligibility, and conduct at physical venues). We provide software only and are not a party to agreements between you and organizers unless we state otherwise.
You may submit content (such as names, scores, and messages) through the Service. You grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and process such content as needed to operate and improve the Service. You retain ownership of your content subject to this license.
Intellectual property
The App, branding, logos, and software are owned by us or our licensors. Except for the limited right to use the Service in accordance with these Terms, no rights are granted to you.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation. Third-party services (such as sign-in providers or messaging apps) are subject to their own terms.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ZERO IF THE SERVICE IS PROVIDED WITHOUT CHARGE, EXCEPT WHERE LIABILITY CANNOT BE EXCLUDED BY LAW.
Indemnity
You will defend, indemnify, and hold harmless us and our affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.
Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we cease offering the Service. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive termination.
Governing law and disputes
These Terms are governed by the laws of Australia, without regard to conflict-of-law rules. You and we submit to the non-exclusive jurisdiction of the courts located in Australia for disputes arising from these Terms, except where prohibited by applicable law.
Changes
We may modify these Terms. We will post the updated Terms in the App and update the “Last updated” date. Your continued use after the effective date may constitute acceptance where permitted by law.
